Terms & Conditions

1. About these terms

These terms apply when you use our website (cuebites.com.au). In these terms, “Cuebites”, “we”, “us” and “our” mean Cuebites Digital Pty Ltd (ABN 16 651 690 603, ACN 651 690 603), a Sydney software studio that builds custom web apps, mobile apps and AI automation for Australian businesses.

By using our website, you agree to these terms. If you don’t agree, please don’t use it.

2. General information only

Our website describes our services and our past work: case studies, product and service pages, timeframes, examples and calculator results. It is general information, not professional, technical, financial or legal advice for your situation, and it isn’t an offer to supply services.

Each project is governed by the written proposal or agreement we give you. It sets out the scope, price, timeline and other terms. If anything on our website differs from your proposal or agreement, the proposal or agreement applies.

We work to keep our website accurate and up to date, but it may contain errors or be out of date. Results in our case studies are examples of past projects, not a promise of the same results for your business.

3. Prices and estimates

Unless we say otherwise, prices, estimates and timeframes on our website are in Australian dollars (AUD) and are indicative only. The ROI calculator estimates savings from the figures you enter; it isn’t a quote or a guarantee. Your fixed price, scope and timeline are set in your written proposal, which also says whether GST is included.

4. Enquiries and bookings

When you send an enquiry or book a call, please give accurate details. Sending an enquiry or booking a call doesn’t create a contract for services, and either of us can decide not to go ahead. Bookings are made through Cal.com’s scheduling service.

5. Intellectual property

We own, or have permission to use, the content on our website, including its text, design, graphics, images, videos and code, and the Cuebites name and logo. Client names, logos and screenshots in our case studies belong to their owners.

You may view, download and print pages from our website for your own information, or to decide whether to work with us. You must not otherwise copy, republish, sell or adapt our content, or use our name or logo, without our written permission, except as the law allows (for example, fair dealing under the Copyright Act 1968 (Cth)).

Ownership of the software we build for you is set out in your project agreement, not in these terms.

6. Acceptable use

When you use our website, you must not:

  • use it for anything unlawful, misleading or harmful;
  • send false or spam enquiries, or enquiries in someone else’s name without their permission;
  • try to gain unauthorised access to our website, our systems or our providers’ systems, or interfere with how they work (for example, with malware, automated attacks or excessive requests);
  • copy or harvest content or contact details from our website by automated means, other than through search engines and crawlers that follow our robots.txt;
  • use it in a way that infringes anyone’s rights, including their privacy or intellectual property.

We may block access or remove material to protect our website, our business or other people.

Our website links to, and embeds, services run by others, such as the Cal.com booking calendar, the Mux video player and our social media pages. We don’t control those services and aren’t responsible for their content, availability or privacy practices. A link doesn’t mean we endorse the website or its owner.

8. Availability and changes to the website

We may change, suspend or remove any part of our website at any time. We don’t promise that it will always be available, uninterrupted or free of errors or viruses.

9. Australian Consumer Law

Our services come with guarantees that can’t be excluded under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these terms excludes, restricts or changes those guarantees, or any other right you have that the law says can’t be excluded.

10. Limitation of liability

To the extent the law allows, we aren’t liable for any loss or damage arising from your use of, or inability to use, our website or its content. This includes indirect or consequential loss, such as lost profits, revenue, data or business opportunities.

Where the law lets us limit our liability for a failure to comply with a consumer guarantee, and the services aren’t of a kind ordinarily acquired for personal, domestic or household use, our liability is limited (where it is fair and reasonable) to supplying the services again or paying the cost of having them supplied again.

Your project agreement sets out our liability for the services we deliver to you.

11. Privacy

Our Privacy Policy explains how we collect, use and share personal information, including through the forms and tracking tools on our website.

12. Changes to these terms

We may update these terms from time to time. The version on this page applies from the date it was last updated, shown at the top, so please check it when you use our website.

13. General

If part of these terms is invalid or unenforceable, it is limited or removed only as far as needed, and the rest of the terms continue to apply. If we don’t enforce a term straight away, we can still enforce it later.

14. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
